  • Failing to disclose additional charges until the final stages of a purchase, which can mislead consumers about the total cost of a product or service.

3. Bait-and-Switch:

  • Advertising a product at a low price to attract customers, only to push them towards a more expensive item or claiming the advertised product is out of stock.

4. Deceptive Comparisons:

  • Making false claims about the prices of competitors’ products to make their own prices appear more attractive.

    Notable Class Action Lawsuits Involving Misleading Prices

    Some of the country’s biggest companies have recently been involved in litigation over misleading prices.

    1. Kohl’s False Discounts Case:

    • Kohl’s faced a class action lawsuit for allegedly inflating original prices to create the illusion of substantial discounts. The plaintiffs claimed that the retailer’s pricing practices were deceptive and violated consumer protection laws.

    2. Ticketmaster’s Hidden Fees:

    • Ticketmaster was sued for not disclosing service fees and other additional charges until the final stages of the ticket purchasing process. The lawsuit argued that these hidden fees misled consumers about the true cost of tickets.

    3. Walmart’s Deceptive Pricing:

    • Walmart was accused of advertising false rollback prices. Plaintiffs argued that the rollback prices were often higher than the regular prices charged in the recent past, misleading customers into thinking they were getting a bargain.

    Many consumer groups have called for legislation to bring more transparency to pricing and discount practices. However, no comprehensive law has been passed to specifically curb misleading pricing.
