3. Social Media Harm Lawsuits Gain National Momentum

Claims alleging mental health harms, addictive design, and youth-targeted algorithmic features are multiplying, and 2026 will be a defining year in this category. Studies continue linking excessive social media use to depression, anxiety, self-harm, and sleep disruption in minors. This newfound evidence, coupled with new youth social media safety laws, is creating private rights of action and expanding liability.

Social media litigation is no longer hypothetical, it’s structurally similar to past waves of mass torts involving tobacco, opioids, and defective products. Expect large-scale consolidation and nationwide filings through 2026.

4. AI Misuse Becomes a New Frontier for Plaintiffs Attorneys

Artificial intelligence is now embedded in business operations, healthcare, financial decisions, vehicles, and everyday apps. With that integration comes liability, and courts are only beginning to see the consequences.
